In accordance with California Court Rule 9.40, lawyers from out of state may appear in California courts upon filing a written application to appear pro hac vice and associating with local counsel as the attorney of record. This provision applies to attorneys who are not residents of California and who belong to the bar of any United States court or the highest court of a territory of the United States.
A pro hac vice application needs to include the following information:
- The applicant's residence and office address;
- The courts to which the applicant has been admitted to practice and the dates of admission;
- Affirmation that the applicant is a member in good standing in those courts;
- Affirmation that the applicant is not currently suspended or disbarred in any court;
- The title of the court and any cause in which the applicant has filed an application to appear as counsel pro hac vice in this state in the preceding two years, the date of each application, and whether or not it was granted; and
- The name, address, and telephone number of the active member of the State Bar of California who is attorney of record.
Attorneys from Northern California may also wish to associate with our firm as co-counsel when the matter is being heard in Kern County courts or neighboring jurisdictions, or when other circumstances make it more efficient to associate with counsel in our area.
